This VAKI Viewer Terms of Service Agreement (“Agreement”) is between you and VAKI (for the purposes hereof, “VAKI,” “we” or “us”). The Agreement governs your use of the “VAKI Service,” an online platform that allows consumers like you to view video programs (“Programs”) from content owners and licensors (“Producers”) through producer-branded websites and applications that we power.
By creating an account, viewing videos, making a purchase, downloading our applications, or otherwise visiting or using the VAKI Service, you accept this Agreement and consent to contract with us electronically.
If you are an entity other than a natural person, the person who registers the account or otherwise uses the VAKI Service must have the authority to bind the entity. In this context, “you” means both the entity and each person who is authorized to access the account.
We may update this Agreement by posting a revised version on our website. By continuing to use the VAKI Service, you accept any revised Agreement.
You may terminate the Agreement at any time by deleting your account. We reserve the right to suspend or terminate your account for your breach of the terms hereof.
In the event of any termination or expiration of the Agreement, the following sections will survive: Section 6 (Disclaimers), Section 7 (Limitation of Liability), Section 8 (Indemnification).
You must create an account to use certain features we offer (e.g., to view a Program). To do so, you must provide an email address. By creating an account, you agree to receive notices from VAKI at this email address.
You may not create an account if you are younger than 16 years of age. By creating an account, you represent that you are at least 16 years of age and, to the extent required by law, you have the permission of a parent or guardian to create an account and use the VAKI Service.
By granting your child permission to use the VAKI Service through your account, you agree and understand that you are responsible for monitoring and supervising your child's usage.
You are responsible for all activity that occurs under your account, including unauthorized activity. You must safeguard the confidentiality of your account credentials. If you are using a computer that others have access to, you must log out of your account after each session. If you become aware of unauthorized access to your account, you must change your password immediately.
You are not allowed to share your account login credentials with anyone else. In case multiple logins using a single login credential is detected, your account will be disabled without further notice.
You may request deletion of your account and associated personal data at any time through your account settings or by contacting us. We will process such requests in accordance with our Privacy Policy and applicable law. Once your account is deleted, you may need to create a new account to use the VAKI Service again.
Please review our Privacy Policy to learn about the information we collect from you when you use the VAKI Service, how we use it, and with whom we share it.
By creating an account, you agree that VAKI will have access to your account information and account activities, such as the viewing and purchase of Programs and your contact information.
VAKI offers the following purchase option through our websites and applications:
You are required to pay a fee in order to watch a specific program.
To make a purchase, you must provide a valid payment method. We may apply taxes, including GST (Goods & Services Tax), to any charges. Prices and other terms of purchase are subject to change.
ALL PURCHASES ARE FINAL AND NON-REFUNDABLE.
Subject to the terms hereof, you have the right to stream for your personal entertainment purposes the programs that you have purchased.
You may not resell streams or downloads, use any Program for any commercial purpose, redistribute or retransmit any Program, publicly perform or display any Program, or make derivative works from any Program.
YOUR USE OF THE VAKI SERVICE IS AT YOUR OWN RISK.
VAKI PROVIDES THE VAKI OTT SERVICE ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
VAKI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the above, VAKI makes no representations or warranties concerning:
Programs may be withdrawn at any time without notice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAKI, ITS PARENT, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, CONSULTANTS, AGENTS, SUPPLIERS, AND PARTNERS (INCLUDING PRODUCERS) SHALL NOT BE LIABLE FOR:
(i) ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES;
(ii) DAMAGES RELATING TO ANY DISPUTE BETWEEN OTHER VAKI USERS.
You shall indemnify, defend, and hold harmless VAKI and its parent, directors, officers, employees, representatives, consultants, agents, suppliers, and partners (including Producers) from any liability, claim, demand, damages, losses, and costs (including attorneys’ fees) arising from:
(i) your unauthorized use of any Program;
(ii) your breach of this Agreement or violation of any law or third-party right;
(iii) any content that you upload or submit to us.
Any unauthorized reproduction or redistribution of the content hosted under the VAKI app is expressly prohibited by law and may result in severe civil and criminal penalties.
Violators will be prosecuted to the maximum extent possible.

VAKI provides access to movies, short films, documentaries, TV series, and other programs. Depending on the program, access may be free, included with a subscription, or available as a time-limited rental.
Rental prices are displayed before payment and may vary by program, rental period, and applicable taxes. Playback quality is selected or adjusted separately and does not determine the rental price unless expressly stated at checkout.
A rental becomes active after successful payment confirmation. Its exact viewing period is shown before purchase and in the rental details. Available rental periods may include 24, 36, 72, 96, or 168 hours, depending on the program.
Programs may be offered free of charge, through a subscription, or as individual rentals. The access option, price, currency, and viewing period shown at checkout apply to the transaction.
Series content may be offered at the episode, season, or full-series level, subject to the options displayed for that title.
Refund requests may be submitted to VAKI support and are reviewed based on the circumstances, viewing activity, applicable law, and the payment provider's rules. A refund is not guaranteed merely because a program was not watched.
Approved refunds may be full or partial. Any non-refundable payment-provider charges or taxes will be handled as required by the provider and applicable law. Access associated with a fully refunded or reversed payment may be revoked.
